Privacy Statement
This statement explains how Audrey Anais Avry, Provisional Licensed Immigration Adviser (Licence No. 202401049), trading as Abeona Immigration Services, handles your personal information. It complies with the Privacy Act 2020 and clause 7 of the Licensed Immigration Advisers Code of Conduct 2014.
1. What information I collect
The personal information you provide for the purpose of immigration advice and visa applications, including: your identity and contact details; your immigration history; your family and relationship details; your employment, qualifications and skills; your financial and (where relevant) health information; and any supporting documents you provide.
2. Why I collect it
To provide immigration advice; to prepare and submit visa applications; to communicate with you and (with your consent) with Immigration New Zealand, employers, education providers, family members, or other relevant third parties; to operate my practice (record-keeping, invoicing, complaints handling); and to comply with my obligations under the Immigration Advisers Licensing Act 2007 and the Code of Conduct.
3. Who has access
The following persons or entities may have access to your information:
• Me, as your immigration adviser;
• My Supervising Licensed Immigration Adviser, Andy O'Dell (with your written consent), solely for supervision purposes required by section 11 of the Immigration Advisers Licensing Act 2007;
• Immigration New Zealand, only as required to support your visa application and only with your authority;
• The Immigration Advisers Authority, only where required for regulatory audit or in response to a complaint;
• Third parties (employers, education providers, family members, agents), only with your prior written consent;
• Service providers who help me operate my practice (e.g. accounting software, secure email and file storage), under appropriate confidentiality obligations.
4. Where it is stored
Your information is stored on Microsoft OneDrive, with data primarily held in Microsoft's Australian/New Zealand data centres. Reasonable security measures are taken to protect your information, including access controls, password protection, encryption at rest and in transit (where supported by the platform), and regular back-up. No system is perfectly secure, but I take the measures appropriate to the sensitivity of the information. Some of the service providers I use may store information in countries other than New Zealand. Where this occurs, I ensure the provider's terms include privacy protections comparable to those in the Privacy Act 2020, in accordance with Information Privacy Principle 12.
5. How long I keep it
Client records are retained for a minimum of seven (7) years from the date your file is closed, as required by clause 26 of the Code of Conduct. After this period, records are securely destroyed.
6. Your rights
Under the Privacy Act 2020 you have the right to:
• Request access to the personal information I hold about you;
• Request correction of any information that is incorrect;
• Withdraw your consent to specific disclosures (where consent is the basis of disclosure);
• Complain about any breach of your privacy (see section 8).
